Mission

The Laboratory for the Research of Medical Law and Bioethics was founded at the Faculty of Law of Aristotle University of Thessaloniki with the Senate Decision No. 2920 / 22.12.2015 (Government Gazette 5B’/08.01.2016).

The Role of the Laboratory is

  1. To teach and help the research of undergraduate and graduate students of Aristotle University of Thessaloniki (AUTh) School of Law, as well as of students from other Departments, concerning the subject of Medical Law and Bioethics, addressing issues such as:
  •         medical liability,
  •         medical ethics,
  •         beginning of the human life,
  •         notion of death,
  •         euthanasia,
  •         living wills,
  •         assisted suicide,
  •         transplants,
  •         cosmetic surgery,
  •         sex change,
  •         human organs trafficking,
  •         medically assisted reproduction,
  •         genetic tests,
  •         gene therapy,
  •         cloning,
  •         abortion,
  •         human experiments,
  •         palliative care,
  •         stem cells research,
  •         sex selection,
  •         genetically modified organisms,
  •         clinical studies,
  •         DNA analysis etc
  1. To develop all kinds of collaboration in the spirit of reciprocity with other Greek and foreign universities or research centers, given that their scientific objectives coincide with, and are in line or complement the ones of the Laboratory.
  2. To organize scientific lectures, workshops, seminars, summer schools, congresses and other scientific events.
  3. Το generate publications and papers and to invite Greek and distinguished foreign scientists.
  4. To develop collaborations with international organizations, public services and other scientific and social carriers, in Greece and abroad, so that the scientific personnel of the Laboratory contributes to the study and to the submission of proposals for the policy planning and alternative means of addressing pertinent issues.
  5. To offer its services to individuals, according to the provisions of the presidential decree 159/1984 (issue A’, no 53).
  6. To provide legal assistance on issues relevant to its area of specialization.
  7. To collect, process, store και provide data in the field of medical law and bioethics.
  8. To engage in consulting work and research, in order to serve the needs of the society in this field.
  9. To maintain its own website and expedite the publication of an e-journal in this field.
  10. To assume any other scientific, research and educational initiative or activity which is relevant in the field.

History

The need for such a Laboratory arose during the implementation of the program “Medically Assisted Reproduction and Protection of the Embryo in Vitro” (February 2014 – October 2015) which was part of ARISTEIA II and was approved and implemented by the Faculty of Law , in collaboration with the AUTh School of Medicine; it was co-funded by the European Union and the General Secretariat of /research and Technology.

During the development of this program, the current legislative framework of seven European countries on assisted reproduction was consulted and the problems stemming from such a framework were foregrounded. In addition to this legislative framework, relative national and international studies were deployed, as well as an updated bibliography. Personal interviews with almost 100 scientists, all experts in assisted reproduction issues, were conducted, including jurists, doctors, psychologists, biologists, theologians, anthropologists and specialists in strategy on assisted reproduction and embryology. Seven national reports were drawn up, which were the rock bed of an extended comparative study; two international conferences were organised in Thessaloniki, Greece, with 57 lecturers in total; the Minutes were published in four volumes in Greek and in English and concrete proposals were drafted – in Greek and in English as well – for the formulation of a European legislative framework in the field of assisted reproduction, through which the complex problems consequent to the legislative restrictions in individual countries can be solved.

These proposals have been sent to the Authorities in Greece and the European Union.

Meanwhile, a website for issues of medically assisted reproduction issues was set up, where one could find all relevant legislation, extensive case law of Greek and European courts, studies, surveys, news and other material. All the research material is also posted on this website (repro.law.auth.gr).

The implementation of the program highlighted the need to strengthen and to broaden the interdisciplinary dialogue in the field of medical law and bioethics. In such a context, a stable structure can offer to the Faculty of Law a set of resources on topics of particular interest not only for the scientific community but for the whole society.

The Laboratory of Medical Law and Bioethics operates in this way, and further evolves this ARISTEIA project, drawing from its results, research tools and database. At the same time, it builds on and maintains all the already founded collaborations of the research team with other universities or institutes domestically and abroad (National and Kapodistrian University of Athens, Panteion University, University of the Aegean, Paris I, Pantheon-Sorbonne, University Sacro Cuore, Göteborg, Mannheim, European University of Cyprus, University of Nicosia, Uppsala University, University Cambridge, Queen Mary University, Manchester University, UCL, Trento University, Augsburg University, London School of Economics), but with national authorities, too, such as the Authority of Medically Assisted Reproduction and the National Bioethics Committee.

Objective

In order for the objectives of the workshop to be achieved:

  • scientific meetings of the laboratory members are organized; other scientists are invited, if it is deemed important, in order to process and to submit statements on current critical issues (“Think Tank”); such meetings promote the scientific dialogue and issue policy recommendations to the relevant bodies,
  • internal scientific meetings of the members of the laboratory are organized, after an AUTh faculty member submits such a request, in order to process scientific issues on the subject of Medical Law and Bioethics, and support the teaching of these specific subjects, in the AUTh Faculty of Law and in other AUTh Schools
  • instruction within the AUTh Interdisciplinary Postgraduate Program “Contemporary Medical Acts: Legal Regulation and Bioethical Dimension”, which is implemented with the cooperation of four AUTh Faculties (Theology, Medicine, Law and Dentistry) is enhanced, as well as the teaching of the undergraduate joint seminar of the new curriculum of the Faculty of Law entitled “Medical liability law”
  • research programs are run in individual sections of the Medical Law and Bioethics, funded by governmental, EU or private sources, with as much an interdisciplinary character as possible,
  • services are offered to individuals, according to the provisions of the presidential decree 159/1984 (issue A’, no 53), as well as opinions (to courts etc) on issues which are relevant to its field according to the statutory legislation,
  • scientific lectures, workshops, conferences on current affairs of high interest are organized for specific audiences or the general public,
  • seminars and summer schools for specific audiences or the general public are organized
  • scientific collaborations are formed with the National Bioethics Committee, the Authority on Medical Assisted Reproduction, Medical Associations, the National School of Judges, other educational or research institutes or other scientific associations and services.
  • partnerships with international organizations dealing with issues of medical law and bioethics are developed,
  • scientific data on medical law and bioethics are collected, processed, stored and distributed,
  • internships can be offered to graduate students; with indexing issues falling within the field of medical law and bioethics and their being posted on the laboratory site, under the mention of the student’s name,
  • graduate students for doctoral studies in this area are financially supported, notably by allowing monitoring of internal meetings, participation in research projects, the use of bibliography etc.
  • findings of surveys or studies conducted within the laboratory are published through its website and through a specialized webzine.

Funding

The Laboratory is funded by:

  1. The research and training (national, European and/or international) projects implemented by it  or on behalf of third parties.
  2. The donations, bequests and any other financial aid to Aristotle University of Thessaloniki.
  3. The revenues from the services rendered in accordance with the Article 3 of the Presidential Decree 159/1984 (A’ 53).
  4. The distribution of results of research projects or of scientific products in general.
  5. The special offers, fundings and other donations from international organizations, public or private companies and legal entities or individuals.
  6. The financing or co-financing of research projects from various Ministries or agencies of the Public Sector.
  7. The sales from Laboratory publications.
